PRIVACY POLICY FOR ModsTune: AI Car Designer

This Privacy Policy explains how personal data is collected, used, stored, and otherwise processed when you use the ModsTune: AI Car Designer Android mobile application and related services, collectively referred to as the “Service” or the “App.”

Please read this Privacy Policy carefully to understand how we process information when you use the Service.

By downloading, accessing, or using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Privacy Policy, you should stop using the Service, cancel any active subscription through Google Play, if applicable, and delete the App from your device.

2. CATEGORIES OF DATA WE PROCESS

We may process information that you choose to provide, information generated through your use of the Service, and certain technical information collected automatically.

The App does not require you to register, create an account, or provide your name or email address to access its primary functionality.

2.1 Photos and images

The App allows you to select an image from your device gallery or capture an image using your device camera.

The Service is designed specifically to process vehicle-related images, including photographs of cars and motorcycles. Images that do not meet the technical or content requirements of the Service may be rejected and may not be processed successfully.

When you submit an image for generation or transformation, the image may be securely transmitted to and processed on our servers or through service providers acting on our behalf. The image is processed solely as necessary to provide the functionality requested by you, including generating, modifying, displaying, storing, or delivering a vehicle design result.

We do not sell your uploaded images. We do not use uploaded images to display advertising within the App. Uploaded images are not used for purposes unrelated to providing, operating, maintaining, supporting, or protecting the Service.

2.2 Prompts and customization information

When using the Service, you may provide text prompts or select customization parameters relating to the requested vehicle design.

This information may include:

  • written descriptions and prompts;

  • selected vehicle type;

  • selected design style;

  • selected color;

  • selected modifications, accessories, or additional elements;

  • generation preferences;

  • feedback relating to generated results.

We process this information to understand your request and generate the corresponding result.

Prompts and customization information are not sold and are not used to display advertising within the App.

2.3 Generated content and projects

The Service creates AI-generated vehicle images based on the image, prompt, and customization options submitted by you.

Generated results and related project information may be stored so that they can be displayed in the My Projects section of the App and remain available when you return to the Service.

Project information may include:

  • uploaded source images;

  • generated vehicle designs;

  • prompts and selected customization parameters;

  • generation status;

  • technical project identifiers;

  • the date or time of generation.

The App does not provide public profiles, public project galleries, or public sharing areas. Your projects are not intentionally made available to other users through the Service.

You may choose to save a generated result to your device gallery. The App saves a result to your gallery only when you initiate the relevant action and grant any permission required by Android.

2.4 Camera and gallery access

The App may request access to your camera or device gallery when you choose to capture or select an image.

Camera and gallery access is used only to enable image selection, image capture, vehicle generation, and saving generated results at your request.

The App does not continuously access your camera or gallery. You may manage or withdraw camera and photo permissions through your Android device settings. Restricting these permissions may prevent certain features from functioning.

2.5 Information provided when contacting support

You may choose to contact us by email for technical support, subscription-related questions, privacy requests, or other assistance.

When you contact us, we may receive:

  • your email address;

  • the content of your message;

  • screenshots, images, or other attachments that you choose to provide;

  • device or App information included in your request;

  • information concerning a purchase or subscription;

  • other information necessary to investigate and respond to your request.

We use this information only to communicate with you, address your request, protect the Service, or comply with applicable legal obligations.

2.6 Technical and usage data

When you access or use the Service, certain technical and usage information may be collected automatically.

Depending on your device, App configuration, permissions, and the technologies used in the Service, this information may include:

  • IP address;

  • device type and model;

  • operating system and version;

  • App version;

  • language and regional settings;

  • time zone;

  • Internet service provider or mobile carrier;

  • device, installation, or application identifiers;

  • Android Advertising ID, where available and permitted;

  • session information;

  • screens viewed and features used;

  • taps, interactions, and generation events;

  • subscription and purchase-related events;

  • crash reports;

  • diagnostic information;

  • performance and error data;

  • referral and installation source;

  • advertising campaign and attribution information.

We use this information to operate and improve the Service, identify and fix technical issues, understand how features are used, maintain security, prevent fraud or misuse, and measure the performance of our marketing campaigns.

The App does not request or use precise or approximate location data for its vehicle generation functionality.

2.7 Purchase and subscription information

The App may offer subscriptions, free trials, introductory offers, in-app purchases, or other paid functionality.

Payments made through the Android version of the App are processed by Google Play. We do not collect or store your full payment card number or complete payment card details.

We may receive limited purchase-related information, such as:

  • product or subscription identifier;

  • purchase or subscription status;

  • whether a subscription is active, expired, renewed, canceled, or refunded;

  • transaction or validation information;

  • eligibility for an offer;

  • other information necessary to provide access to paid functionality.

We may use service providers, including Adapty, to validate purchases, manage subscription status, display available offers, and provide access to premium features.

Google Play and other payment-related service providers process payment information in accordance with their own privacy policies and terms.

3. PURPOSES FOR WHICH WE PROCESS DATA

We may process information for the following purposes.

3.1 Providing the Service

We process data to:

  • enable you to select or capture a vehicle image;

  • process uploaded images;

  • interpret prompts and customization selections;

  • create AI-generated vehicle designs;

  • display generated results;

  • maintain the My Projects section;

  • allow you to save results to your device;

  • provide free and premium features;

  • maintain the availability and operation of the Service.

3.2 Processing images and generating content

Uploaded images, prompts, and customization information are processed to perform the generation requested by you.

Processing may include transmitting information to secure servers, analyzing whether an image is suitable for the Service, generating a new vehicle design, storing project information, and delivering the result to your device.

We do not sell uploaded images, prompts, or generated content. We do not use this content to display advertisements within the App.

3.3 Maintaining projects

We may retain project information to maintain the My Projects functionality and allow previous generation results to remain accessible through the App.

Because the App does not require an account, projects may be associated with technical identifiers rather than your name or email address.

3.4 Providing support

We process information submitted through support communications to:

  • respond to questions;

  • investigate technical issues;

  • assist with purchase or subscription inquiries;

  • address privacy requests;

  • prevent misuse;

  • improve the reliability of the Service.

3.5 Analytics and service improvement

We may process technical, diagnostic, and usage information to:

  • understand how the Service is used;

  • measure feature performance;

  • identify crashes and errors;

  • improve functionality and usability;

  • test and optimize App features;

  • maintain technical stability;

  • prevent fraud and abuse.

We may use technologies and services including Firebase Analytics, Firebase Crashlytics, AppsFlyer, Meta SDK, and similar tools for analytics, crash reporting, attribution, diagnostics, and service improvement.

3.6 Attribution and marketing measurement

We may use technical identifiers, installation information, and interaction data to understand how users discover the App and to measure the effectiveness of advertising and promotional campaigns conducted outside the App.

The App does not display third-party advertising within the Service. However, attribution and marketing technologies may help us understand whether an external campaign resulted in an installation, subscription, purchase, or other interaction.

Where required by applicable law, such processing will be based on your consent or another valid legal basis. You may be able to manage advertising identifiers and related privacy choices through your Android or Google settings.

3.7 Communications and notifications

The App may send push notifications or in-app messages relating to:

  • generation status;

  • feature updates;

  • service notices;

  • reminders;

  • subscription information;

  • offers or promotional information;

  • changes affecting the Service.

You can disable push notifications at any time through your Android device settings.

3.8 Payments and premium access

We process limited purchase and subscription information to:

  • confirm payment status;

  • unlock premium features;

  • manage subscription access;

  • determine offer eligibility;

  • restore or validate purchases;

  • respond to billing-related support requests;

  • prevent payment fraud.

3.9 Security, fraud prevention, and legal compliance

We process data when necessary to provide the Service requested by you, including processing images, generating vehicle designs, maintaining projects, providing premium access, and responding to support requests.

  • detecting and preventing fraud or misuse;

5. SERVICE PROVIDERS AND DATA SHARING

  • AI processing and generation service providers;

  • analytics providers, including Firebase;

  • crash reporting and diagnostic providers, including Firebase Crashlytics;

  • attribution and marketing measurement providers, including AppsFlyer and Meta;

  • subscription management providers, including Adapty;

  • payment and app distribution providers, including Google Play;

  • push notification and communication providers;

  • security, infrastructure, and technical support providers.

Service providers may process information only as necessary to perform their services, subject to their contractual obligations, applicable terms, and privacy requirements.

We may also disclose information:

  • when required by applicable law or valid legal process;

  • to protect our rights, property, users, or systems;

  • to investigate fraud, misuse, security incidents, or unlawful conduct;

  • in connection with a merger, acquisition, restructuring, financing, or transfer of all or part of our business;

  • with your consent or at your direction.

We do not sell your uploaded vehicle images, prompts, or generated projects.

6. DATA RETENTION

We retain information for as long as reasonably necessary to provide, maintain, protect, and support the Service and to fulfill the purposes described in this Privacy Policy.

Uploaded images, prompts, customization information, generated content, and project information may be retained to maintain the My Projects functionality, preserve access to previous results, ensure technical continuity, investigate technical issues, prevent misuse, and support the operation of the Service.

Where no specific retention period is required, information may be retained while it remains reasonably necessary for these purposes. We may delete, anonymize, or aggregate information when it is no longer reasonably required, subject to technical, contractual, and legal considerations.

Technical, analytics, diagnostic, attribution, and subscription-related information may be retained in accordance with our operational requirements and the retention practices of the relevant service providers.

Support correspondence may be retained for as long as reasonably necessary to resolve requests, maintain support records, protect our rights, prevent fraud, and comply with applicable obligations.

Certain information may be retained for a longer period where necessary to comply with law, resolve disputes, enforce agreements, prevent fraud, or establish, exercise, or defend legal claims.

7. DATA SECURITY

We use reasonable administrative, organizational, and technical measures designed to protect information against unauthorized access, loss, misuse, alteration, disclosure, or destruction.

These measures may include secure network connections, access controls, restricted access to systems, monitoring, and the use of reputable infrastructure and service providers.

However, no method of electronic transmission or storage is completely secure. Therefore, while we take appropriate steps to protect information, we cannot guarantee absolute security.

We and our service providers may process information in countries other than the country in which you live.

The App does not require an account. Therefore, we may need to request information reasonably necessary to verify your request and identify data associated with your use of the Service, such as a project identifier, device or installation identifier, purchase information, screenshots, or other relevant technical information.

In some circumstances, we may be unable to identify particular information using an email address alone. We will make reasonable efforts to assist based on the information available.

We may retain certain information where required by law or where necessary to protect legal rights, prevent fraud, maintain security, resolve disputes, or enforce agreements.

You may also remove locally stored App information by deleting the App or clearing its data through your Android device settings. Removing the App or clearing local data may not automatically delete information previously transmitted to our servers or service providers.

10. ANDROID PERMISSIONS AND DEVICE CONTROLS

Depending on the features you use, the App may request permission to access:

  • your camera;

  • selected photos or media;

  • notifications;

  • storage or media-saving functionality, where required by the Android version.

Permissions are requested only when necessary to provide the relevant feature.

You may grant, deny, or withdraw permissions through your Android device settings. If you deny or withdraw a required permission, the associated feature may not function properly.

The App does not require access to your location to provide its vehicle generation functionality.

11. ARTIFICIAL INTELLIGENCE FEATURES

The Service uses artificial intelligence technologies to generate or transform vehicle-related visual content based on the images, prompts, and customization options submitted by users.

AI-generated results may not always be accurate, realistic, complete, or consistent with every requested detail. Generated results are provided for creative and entertainment purposes.

The App is designed for vehicle-related generation. Images or requests that do not meet technical, safety, or content requirements may be rejected, restricted, or fail to generate.

We may use automated systems and technical safeguards intended to prevent misuse and restrict unsupported or inappropriate requests.

12. CHILDREN’S PRIVACY

The Service is not directed to children under the age of 13, or a higher minimum age where required by applicable law.

We do not knowingly collect personal data from children below the applicable minimum age without appropriate authorization.

If you are a parent or legal guardian and believe that a child has provided personal data through the Service contrary to applicable law, please contact us at aicardesmods@gmail.com. We will review the request and take appropriate action.

Where required by law, a parent or legal guardian must review and consent to this Privacy Policy before a child uses the Service.

13. THIRD-PARTY LINKS AND SERVICES

The Service may contain links to websites, stores, platforms, or services operated by third parties.

We do not control and are not responsible for the content, security, or privacy practices of third-party services. We encourage you to review the privacy policies and terms of any third-party service you access.

Google Play, Google, Firebase, Meta, AppsFlyer, Adapty, and other providers process information in accordance with their own terms and privacy policies.

14. BUSINESS TRANSFERS

If Market2I is involved in a merger, acquisition, financing, restructuring, sale of assets, insolvency, or similar transaction, information processed in connection with the Service may be transferred as part of that transaction.

Where required by law, we will take reasonable steps to inform users of material changes affecting the processing of personal data.

15. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes to the Service, technologies, legal requirements, or our data practices.

When we make changes, we will update the “Last updated” date at the beginning of this Privacy Policy. Where required by applicable law, we may provide additional notice through the App or another appropriate method.

We encourage you to review this Privacy Policy periodically.

Changes become effective when the updated Privacy Policy is published, unless a different effective date is stated.
